Bwangu credit ("we," "us," or "our") offers users the opportunity to acquire lending financing services. By utilizing the Services, creating an account, logging in, or downloading and installing the Bwangu credit (collectively, the "Apps"), you consent to these terms.

It is important that you thoroughly review these terms of use and determine whether they are applicable to your personal or financial circumstances prior to utilizing the services or creating an account. If you do not agree with these terms of use, you should immediately stop using the services.

You are responsible for regularly reviewing the content posted on the Apps in order to receive timely notification of any modifications to these Terms of Use. By continuing to utilize the services, you consent to the revised terms of use upon their publication.

1. PROVISION OF THE SERVICES

If you have registered and your account has been approved by us, you will be able to apply for the Services. These Terms of Use and the terms and conditions specified in the Bwangu credit Credit Agreement will apply to any lending financing services that we provide you. You acknowledge and agree to this.

2. ELIGIBILITY FOR THE SERVICES

When you submit an application for the Services or establish an account, you represent and warrant to us that:

You are a resident of the Republic of Zambia and are eighteen (18) years of age or older.

You possess a current Zambian ID.

You acknowledge and agree to fulfill any payment obligations that arise from the Services you have received in accordance with the payment conditions outlined in the Bwangu credit Credit Agreement.

3. CREDIT DECISIONS

Bwangu credit has the sole authority to determine whether to approve or deny credit and consumer financing services. You acknowledge and consent that Bwangu credit shall not be held accountable for the decision to grant or deny credit, or for any consequences that may result from such decisions, including but not limited to financial loss or damage, denial of opportunities, or any other adverse effects. We are not obligated to provide any justification for our credit decisions.

4. ACCOUNT PROTECTION AND IDENTITY

To access the Services, you need to establish an account. You are required to provide accurate, comprehensive, and current information about yourself during the registration process. You also agree to promptly update your account information as necessary to ensure it remains accurate, complete, and up-to-date. You are responsible for restricting access to the devices you use to access the Apps and Services, as well as safeguarding the privacy of your password and account information. You acknowledge that you are responsible for all actions taken using your account or password.

5. DISBURSEMENTS AND CHARGES

The Bwangu credit Credit Agreement outlines the rates for the Services and any additional fees, such as late payment penalties. You are accountable for all fees and expenses associated with the Services. By utilizing the Services, you authorize us to deduct any amounts due to us under the terms of the Services from the funds in your selected payment account.

6. AVAILABILITY THROUGH THIRD-PARTY APPS

These Terms of Use also apply when the Services are accessible through other platforms, applications, or services, such as Bwangu credit. You represent and warrant that your use of the Services on or through such other applications, platforms, or services is in compliance with their terms and conditions. By accessing or utilizing the Services through such other applications, platforms, or services, you consent to be bound by these Terms of Use.

7. USE OF THIRD-PARTY SUPPLIERS

Bwangu credit may employ outside contractors, agents, or service providers to assist in the delivery of the Services or to manage tasks on our behalf. By utilizing the Services, you acknowledge and agree that these third-party service providers may require access to account information, personal information, and other data to perform their services for Bwangu credit. You also acknowledge and consent that Bwangu credit is not responsible for any actions or inactions of these third-party service providers, provided that Bwangu credit has made a good faith effort to select reputable service providers and ensures they will manage your information in accordance with our privacy policy and applicable laws.

8. PRIVACY AND DATA PROTECTION

Your privacy is highly regarded by us. We will manage your personal information in accordance with our Privacy Policy, which is incorporated into these Terms of Use. By utilizing the Services, you acknowledge that you have read and understood our privacy policy and consent to the collection, use, and dissemination of your personal information as outlined in it.

9. CONSENT TO PERSONAL DATA PROCESSING

When you utilize the Services and provide us with your personal information, you explicitly consent to Bwangu credit's collection, use, storage, and processing of your information in accordance with our Privacy Policy. You are aware that, in order to enhance your user experience, comply with relevant laws and regulations, and provide the Services, we may disclose your personal information to third parties, as outlined in our Privacy Policy. By creating an account or utilizing the Services, you confirm that you have read, understood, and consent to the terms of our Privacy Policy, which is incorporated by reference into these Terms of Use.

10. PARTICIPATE IN COLLECTION ACTIVITIES

In the event of any default or failure to repay any amounts owed to us, Bwangu credit may pursue collection actions in compliance with the terms of the Bwangu credit Credit Agreement and any applicable laws and regulations. You understand and agree to this by using the Services and agreeing to the terms of the Bwangu credit Credit Agreement. Collection actions may involve contacting you via phone, email, text, or other means of communication; engaging external collection agencies; and notifying credit reporting agencies of any defaults or delinquencies. In addition, you authorize Bwangu credit to contact the references you included in your application for the Services to assist with information verification or collection. Additionally, you consent to provide accurate and up-to-date contact information for the purpose of collection actions and to work with Bwangu credit and any third-party collection agencies to resolve any outstanding balances or disputes.

11. CLIENT SUPPORT AND REPORTS

We are committed to ensuring that you receive exceptional services and that any complaints or concerns you may have are resolved in a timely and effective manner. If you have any complaints or concerns regarding the Services or any aspect of your experience with Bwangu credit, please do not hesitate to contact our customer support staff at service.major@bwangu-credit.com. Upon receipt of your complaint, we will promptly address it and endeavor to identify a solution that is both timely and effective. Please include a comprehensive description of your complaint or concern, as well as any corroborating documents or information that can assist us in resolving the issue, in your email.

12. CONSENT FROM OTHER PARTIES AND ELECTRONIC COMMUNICATIONS

By providing your email address and/or cellphone number and using the Services, you consent to receiving electronic messages from Bwangu credit, which may include notifications, confirmations, disclosures, and other information regarding your account, transactions, and utilization of the Services. You acknowledge that all agreements, notices, disclosures, and other communications we send to you electronically fully satisfy any legal requirement that these communications be in writing.

HYPERLINKS TO OTHER WEBSITES

The App or Services may contain hyperlinks to websites, services, or resources that are operated by third parties. You acknowledge and consent that Bwangu credit shall not be held responsible for any loss or damage that may arise from your use of or reliance on any of the aforementioned third-party websites, services, or resources. Bwangu credit is not liable for the content, accuracy, or availability of third-party websites, services, or resources.

15. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the App, the Services, and any materials, content, or information that we provide are under the control of Bwangu credit or its licensors. You undertake not to duplicate, reproduce, modify, distribute, or create derivative works from any content or materials provided by us without our prior written authorization. You further acknowledge that you have no rights, title, or interest in or to any such intellectual property.

16. TERMINATION AND SUSPENSION

We may, at our sole discretion, terminate or suspend your account and access to the Services at any time and for any reason, including but not limited to if we believe you have violated these Terms of Use or have participated in any illicit or unlawful behavior. You may terminate your account at any time by providing us with a formal notice. The App must be immediately removed from your devices, and you will be unable to use the Services after termination. Your termination will not effect any accrued liabilities or monies owing to us.

17. LIMITATION AND DISCLAIMER OF LIABILITY

The Services are provided "as is" and "as available," without any express or implied warranties, to the utmost extent permitted by applicable law. Bwangu credit does not provide any assurances regarding the Services' availability, accuracy, or complete security. In no event will Bwangu credit be held accountable for any indirect, incidental, special, consequential, or punitive damages that may result from your use of or inability to use the Services, even if it has been advised of the potential for such damages. This encompasses Bwangu credit and its officers, directors, employees, agents, licensors, or suppliers.

18. REIMBURSEMENT

In the event that you violate any applicable laws, regulations, or third-party rights, or if you use the Services in violation of these Terms of Use, you agree to indemnify, defend, and hold harmless Bwangu credit, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees).

19. Modifications to the Terms of Use

We reserve the right to modify these Terms of Use at our sole discretion at any time. Modifications to these Terms of Use will be immediately effective upon their publication on the Apps or notification via the contact information you have provided. It is your responsibility to monitor the Terms of Use for any updates and to stay informed about any modifications. You will implicitly accept any changes or amendments to these Terms of Use that are posted if you continue to use the Services. If you are not in agreement with the revised Terms of Use, you should immediately cease using the Services and remove the Apps from your devices.

20. ASSIGNMENT AND DELEGATION

You are not permitted to assign, transfer, or delegate any of your rights or responsibilities under these Terms of Use without our prior written consent. However, we may assign, transfer, or delegate all or a portion of our rights and responsibilities under these Terms of Use to any affiliate or in connection with a merger, acquisition, asset sale, or other business transaction without your consent.

21. FORCE MAJEURE

Except for payment obligations, neither party will be held responsible for any failure or delay in performing under these Terms of Use due to acts of God, war, terrorism, natural disasters, pandemics, government regulations, strikes, or issues with communication or utilities.

22. WAIVERS

No provision of these Terms of Use can be waived unless the party seeking to enforce it signs and documents the waiver in writing. The failure of any party to exercise or enforce any right or provision of these Terms of Use will not be considered a relinquishment of that right or provision.

23. SEVERABILITY

If any provision of these Terms of Use is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. A valid, legal, and enforceable provision that most closely embodies the parties' original intent shall be considered to replace the invalid, illegal, or unenforceable provision.

24. ENTIRE AGREEMENT

These Terms of Use, along with the Bwangu credit Credit Agreement, Privacy Policy, and any other referenced policies or guidelines, constitute the entire agreement between you and Bwangu credit regarding the Services. They supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

25. NO THIRD-PARTY BENEFICIARIES

Except as otherwise specified in these Terms of Use, no rights or remedies are granted to any individual or entity other than you and Bwangu credit. There are no third-party beneficiaries to these Terms of Use.

26. HEADINGS

The titles of these Terms of Use are for convenience only and do not affect the interpretation or construction of any of their provisions.

27. NOTICES

Any written notices or other communications required or authorized by these Terms of Use shall be sent to the addresses or email addresses provided during the account registration process, or as updated by either party from time to time. Notices or communications shall be deemed given when they are delivered personally, sent by registered or certified mail, or sent by email (with acceptance of receipt).

28. GOVERNING LAW AND DISPUTE RESOLUTION

The interpretation of these Terms of Use and any related disputes shall be governed by the laws of the Republic of Zambia. The Republic of Zambia courts shall have exclusive jurisdiction over any dispute, controversy, or claim that arises out of or relates to the Services or these Terms of Use.
